			<content:encoded><![CDATA[<p>It seems that a lot of people in the state of Washington are concerned over the internet lending industry, but my worries are that they are not doing enough research before applying for an online payday loan.  <a href="http://www.bizjournals.com/seattle/blog/2011/04/dfi-warns-against-unlicensed-lenders.html">Just as in Washington,</a>there are businesses all around the internet that are not legitimate.  It is the job of consumers to educate yourself if you are providing your personal information to a website.  There are numerous legitimate websites out there (including Leadpile&#8217;s) that allow a consumer to securely request a payday loan.  If you are a consumer and needing that extra short term cash, do your homework on the website you are filling out your information and make sure you are completing an online form that is secure.   If there are issues in WA, there are potentially issues all over the US, but a lot of this lies with the consumers and knowing what you are doing.  Knowledge is power for consumers! </p>

These loans are overly scrutinized as bad for a consumer because their listed APR, which really is not applicable to a short term loan that does not last a year.  <a href="http://www.columbiamissourian.com/stories/2011/03/24/payday-loans-money-saving-credit-some/">The Missourian</a> pointed up some positive benefits to the payday loans.  For instance, &#8220;Research from the Federal Reserve Board indicates that such loans are not &#8220;predatory.&#8221; Rather, by supplying credit where otherwise there would be none, they help borrowers by enabling them to avoid less-desirable alternatives, such as fees associated with bounced checks, late bill payments and utility reconnections.&#8221;  If the Federal Reserve Board understands there is value added to these types of loans, why are so many politicians and consumers looking down on payday loans as a &#8220;bad&#8221; option?  Have they never had a reason to get a short term loan for some unexpected expense????  Probably not&#8230;. </p>

			<content:encoded><![CDATA[<p>In recent payday loan <a href="http://starglobaltribune.com/2010/colorado-passes-new-law-on-payday-loans-and-caps-apr-at-45-percent-968">news</a>, the state of Colorado has passed a law restricting the APR on payday loans.  The new law puts a cap of 45% APR.  This is just following suit with some other states that have put some sort of restrictions on these short-term loans.  Other states that have some sort of payday loan legislation or the payday loans are banned are the states of:  AZ, AR, CT, GA, ME, MD, MA, NH, NJ, NY, NC, OH, OR, PA, VT and WV.<br />
Many talk about installment loans or other short-term loan options.  Is there going to be a transition from what we all know as a &#8220;payday loan&#8221; to something else to help those consumers that need the help?  Either way, there HAS to be an option for consumers. If we want to call it payday loan.. installment loan, or whatever, consumers need to have somewhere to turn for unexpected situations that happen in their lives.</p>

<p class="MsoNormal"><span style="Bookman Old Style;"><span style="'Bookman Old Style';">3.  The customer is employed for at least <strong><span style="bold;">6 months</span></strong> and making at least <strong><span style="bold;">$1200-$1500/month</span></strong> income.</span></span></p>
<p class="MsoNormal"><span style="Bookman Old Style;"><span style="'Bookman Old Style';">4.  The customer is <strong>e<span style="bold;">mployed</span></strong>, not receiving benefits or self employed.</span></span></p>
<p class="MsoNormal"><span style="Bookman Old Style;"><span style="'Bookman Old Style';">5.  The customer provides <strong><span style="bold;">accurate banking information</span></strong> and other information on their application (payday lead buyers have a way of confirming if it is invalid bank routing# or invalid social security numbers).</span></span></p>
<p class="MsoNormal"><span style="Bookman Old Style;"><span style="'Bookman Old Style';">6.  The customer is not in default on another payday loan or not actively in the process of getting a payday loan with another lender (will show as a duplicate in <strong><span style="bold;">Teletrack</span></strong>).</span></span></p>
<p class="MsoNormal"><span style="Bookman Old Style;"><span style="'Bookman Old Style';">7.  Some states have implemented payday lending laws and those leads will have a harder chance at selling if they sell at all.</span></span></p>
<p class="MsoNormal"><span style="Bookman Old Style;"><span style="'Bookman Old Style';">8.  Some payday lead buyers do not buy on the weekends, because they are not there to work the leads.</span></span></p>
<p class="MsoNormal"><span style="Bookman Old Style;"><span style="'Bookman Old Style';"> The question is, when will these criteria change or when will another state implement payday lending laws that prohibit these kinds of loans?  This lead type reminds me of the subprime mortgage era. The best of the best will have to keep up on the laws, and what the payday lenders are really looking for to be successful in generating this lead type. Some of these customers really do need the assistance and this payday loan will make or break if they &#8220;survive&#8221; to their next payday.</span></span></p>

House Bill 545 caps the annual percentage rate on payday loans in the state at 28 percent, down from the 391 percent maximum currently permitted. Among other provisions, the bill also limits consumer borrowing at $500 or 25 percent of base monthly pay per loan, restricts borrowing to four times per calendar year and extends the term of a loan to 31 days from 14 days. According to Business First of Columbus, The legislation&#8217;s 90-day window closes at the end of August, when some of the more than 1,600 payday lending shops in the state already have indicated they&#8217;re planning to shut down. Lenders have said that among the law&#8217;s provisions, the new APR cap could hurt the industry by making their short-term loans unprofitable. H.B. 545, which was introduced in the House April 29, cleared the Ohio Senate May 14. Let’s hope Ohio has not overreached causing pain for their own constituents.</p>
